Guidya Service Terms of Use

    Effective date: October 2025

    Please read these Terms of Use carefully. Accepting and complying with them is required to use the features we offer.

    1. Preamble

    To make these Terms of Use (“TOU”) easier to read, we refer to “Guidya Service”, the “Service”, or “Services” as the website(s) hosting the services we offer. The Guidya Service is the exclusive property of JOBGATE (“we”), a Moroccan LLC (SARLAU), with registered office at 13 BD MED V, 3rd floor, Lot AL Yousser, Berrechid, registered under RC – 17 705.

    Downloading all or a quantitatively substantial part of the Service using robots or any other automated extraction procedure is prohibited.

    2. User accounts

    Guidya offers three categories of user accounts, each associated with specific services:

    • Member account — reserved for students and graduates seeking employment, internships, or apprenticeships, information on careers and employers, and recruitment advice;
    • Recruiter account — reserved for any representative of a legal entity (“Company”) wishing to present its activities, roles, events, and job postings on the Service via the company area, the Guidya job posting form, or the institution-specific job posting form. It is managed by an authorized representative of the Company, the “Recruiter”, acting on behalf of the Company;
    • Administrator account — reserved for any representative of a higher education institution (“Institution”) offering a career space to its students. It is managed by an authorized representative of the institution, the “Administrator”, acting on behalf of the Institution.

    In this document, “Users” refers collectively to Members, Recruiters, or Administrators.

    3. General presentation

    3.1 Student and graduate Members

    Guidya offers an integrated ecosystem for your professional integration, allowing you in particular to:

    • Apply to job or internship offers;
    • Register for recruitment or career events;
    • Be visible to recruiters according to the features available to you;
    • Receive customized email alerts about offers and events matching your criteria, as well as tips or information to support your professional integration;
    • Use career guidance modules.

    As of the date of these TOU, the Service is available at https://www.guidya.com/

    Services offered in this context are reserved for students or graduates of Guidya’s partner schools and universities as part of their professional integration efforts.

    3.2 Recruiters

    The Guidya Service allows you, as a Recruiter, to publish job or internship offers, create your company space, present your Company through pages or videos, and share your events and news. Unless Guidya expressly agrees otherwise, you may only post offers on behalf of your Company and may not post offers on behalf of another company.

    3.3 Institution

    Guidya offers a Service dedicated to the professional integration of enrolled students and graduates, allowing them to apply to job or internship offers matching their criteria, discover hiring companies, and register for career events. Guidya also provides features for Administrators of Guidya partner institutions, including student pre-registration and management of the institution’s page. The partnership is governed by a specific contract between the Institution and Guidya.

    4. Access to the Service

    To access the Service, you must have suitable hardware (computer, smartphone, tablet, etc.), an internet connection, and any required software. Communication protocols are those in use on the Internet. Access to the Service itself is free for Members and Administrators. Costs of accessing and using the telecommunications network, including remote communication, remain your responsibility according to your access provider and carrier.

    5. Creating a User account

    5.1 Creating a Member account (students and graduates)

    To create a Member account — required when you wish to apply to a job or internship offer, or save an offer for later — you must complete the online registration form. The form asks for personal information (name, email, higher education institution where you study or graduated, type of contract sought, desired role, etc.) needed to open your account; some fields are mandatory (marked with an asterisk *).

    You access your account with an identifier (your email address) and a password you choose during registration. For the security of your data, you must choose a strong password and keep it confidential. Your password must be strictly personal and must not be shared with third parties.

    Reusing the same password across different sites or services increases identity theft risk; weak security on one site can undermine security on others, even those with strict rules.

    Authentication with this identifier and password attributes actions performed through the Service to you. If you lose your credentials and have not notified us, you remain responsible for all operations or content posted through that account.

    Any use of robots or other methods to create a Member account automatically is prohibited. Guidya may delete or block any account that breaches these terms.

    5.2 Creating a Recruiter account

    A Recruiter account is required when you wish to publish a job or internship offer or other content on the Service.

    To create a Guidya account and benefit from all Services including multi-posting of your offers, you must follow the instructions Guidya provides to the Company you represent.

    When creating the Recruiter account and accepting these TOU, you personally warrant to Guidya that you have all authority and authorization to bind the legal entity you designate in the registration form under “Company information”, and generally for all information you provide about the Company.

    You acknowledge that you can validly bind the Company for all acts you perform through the Service.

    We may in the future allow you to delegate use of part or all of Guidya’s Services to other individuals representing your Company, with different permissions by feature. If such delegation is active, you warrant that those persons have authority to bind the Company and you remain liable as delegator for their actions.

    These TOU apply to all such persons. You agree to inform them of the rules they must follow and guarantee compliance. When publishing content describing the Company you represent or job/internship offers in its name, you agree to comply with the “Liability” section below to keep the Service welcoming and effective.

    You access your account with your email and a password you choose. Choose a strong password. The Company you represent and you are responsible for confidentiality, including accidental disclosure, transmission to third parties, loss, or theft.

    The password must remain personal and not be shared. Reusing passwords across services increases risk as explained above.

    Authentication attributes all operations and content posted through the account to the Company you represent, which may be directly liable.

    The Company warrants it will provide representatives, including you, with technical, software, and human means to ensure secure internet exchanges with us (antivirus, firewall, patch management, etc.).

    Automated creation of Recruiter or other accounts is prohibited; Guidya may delete or block offending accounts. Automated posting across multiple Institutions to the detriment of quality is prohibited; Guidya may remove accounts or offers if posting exceeds a reasonable volume.

    5.3 Creating an Administrator account

    Your account is created on request under the partnership agreement with the Institution you represent. You acknowledge the Institution provided the personal data required to create the account (name, email, etc.).

    Further information on why and how we process your data is in our Privacy Policy, annexed to these TOU. Please read it carefully.

    You agree to provide accurate, up-to-date information if what the Institution transmitted was not.

    You are responsible for securing authentication credentials under the rules between you and the Institution. Use of credentials is attributed to the Institution, which may be liable.

    6. Services offered by Guidya

    6.1 Services for student and graduate Members

    We provide informational content to support your professional integration: job and internship offers, career events, employer pages describing roles and hiring practices, tips to find a job or internship, career guidance modules, etc.

    Once registered, you may save offers or events for later or apply. You may create alerts for offers matching your criteria and upload your CV for visibility to Guidya partner Recruiters.

    6.2 Services for Recruiters

    Under the general Guidya Service, provided the Company you represent is a Guidya customer, you may publish content.

    What you may publish and which service level you access depends on your Recruiter account tier:

    • By default, you may create your Company page, post internship or job offers, and track applications on the platform;
    • If Guidya allows, based on the service level purchased by the Company you represent, you may run recruitment events and access profiles of registered students and graduates.

    The Company acknowledges that neither Guidya nor an Institution acting for Guidya in technical validation is required to review offer or Company presentation content (wording, targeting, etc.); that content is solely the Company’s responsibility.

    The Company also acknowledges that Guidya may unpublish content such as an ad if it breaches the “Liability” framework below or if a participant (Member, visitor, etc.) submits a written, reasoned request alleging unlawfulness. Guidya is not liable for such removal.

    6.3 Services for Administrators

    As Administrators of a Guidya partner Institution, we delegated Member pre-registration (students and graduates). You may also consult the CV library of your students and graduates. These actions must comply with these TOU, including for online content and comments.

    You may monitor how students use Service resources to optimize internship or job search and support them in line with the Institution’s mission.

    7. Liability

    7.1 Your liability

    In general, you and, where applicable, the Institution or Company you represent are responsible for:

    • Proper functioning of your equipment and internet access;
    • All direct or indirect damage of any kind caused by content you posted on the Guidya Service;
    • Content you may publish on the Service, whatever its nature (name, compensation, date of birth, comments, etc.), substance, or origin (download, publication, transmission, or making available).

    Guidya is intended to support Members in professional integration; it must not be misused to post unlawful content or statements.

    You and, where applicable, the Institution or Company you represent agree to comply with applicable laws and in particular you must not (non-exhaustive list):

    • Impersonate a third party;
    • Publish or knowingly validate false, incorrect, or misleading content;
    • Interfere with access to or operation of the Guidya Service in any way;
    • Publish content infringing third-party intellectual property rights;
    • Publish racist, xenophobic, antisemitic, homophobic, denialist, pornographic, pedophile, child-exploitation-related content, or content violating human dignity;
    • Publish content inciting violence, suicide, terrorism, or illicit substance use, production, or distribution, or inciting or glorifying crimes or offenses, including crimes against humanity;
    • Publish insulting or defamatory content, or content violating privacy, image, or personality rights of others, or contrary to public order, law, or decency;
    • Publish commercial or advertising information without our prior written consent, except information describing your Company in the Company space you created as a Recruiter;
    • Publish hyperlinks to sites whose content would breach these rules;
    • Use personal data you access on the Service for purposes other than those permitted under our Privacy Policy;

    Unauthorized access to or fraudulent maintenance in a computer system, obstructing or distorting its operation, or fraudulently introducing or altering data constitutes offenses subject to penalties, as does misuse of personal data processing.

    If you breach these rules, we may block access to some or all Guidya features or delete your account temporarily or permanently, without compensation or prior notice, and seek damages.

    If a third party complains about information or data from you or posted on your Account, you must promptly provide explanations and evidence and indemnify us and affected third parties for harm and consequences under applicable law, including criminal liability.

    If you suffer harm from another User’s conduct that breaches these rules, contact us at hello@guidya.com with the subject line “Complaint – Abuse”.

    7.2 Our liability

    We remind you that:

    • We do not verify accuracy of content you upload through the Service;
    • We do not verify Recruiters’ job postings, which are their sole responsibility. We are not liable for non-compliance with laws (labor, equal opportunity, etc.) or public order. We are not involved in hiring or non-hiring decisions resulting from offers on the Service.

    Guidya provides a platform connecting students, graduates, and employers. Guidya does not participate in recruitment, makes no hiring or internship decisions, and is not liable for choices by recruiters or companies.

    We use reasonable efforts to provide quality access and 24/7 availability but have no obligation to achieve it. We may interrupt or suspend access for maintenance or force majeure without liability.

    We are not liable for damages of any kind from use of Guidya. We are also not liable for:

    • Network or server failures or other events beyond our reasonable control that prevent or degrade access, or damage to your technical environment (computers, software, network equipment, etc.);
    • Another user’s use of published information, available services, or your content.

    8. Personal information

    As “data controller” under applicable law, purposes, data types, recipients, retention, and security measures are described in our Privacy Policy annexed to these TOU. Please read it.

    9. Withdrawal and account closure

    9.1 Student and graduate Members

    As stated in our Privacy Policy, your account will be deleted after more than two years of inactivity.

    A few weeks before that deadline, and at the deadline, we will email you to ask whether to keep or delete your account.

    After effective closure, your data will be irreversibly anonymized and used only for statistics and service improvement.

    9.2 Recruiters

    To close your Recruiter account, contact your Guidya advisor who set up your account. If not closed, it will be deleted after two years of inactivity.

    If the Company you represent does not renew the Service, access will be suspended when Guidya’s services to the Company end.

    9.3 Administrators

    To close your Administrator account, contact the Institution you represent; only it can act. If not closed by the Institution, the account will be deleted after two years of inactivity.

    If the Guidya–Institution agreement is not renewed, your account will also be closed according to that agreement.

    10. Hyperlinks

    The Service may include information from external sites or links to sites we did not develop or operate. We do not verify whether such content is reasonable, current, accurate, or complete. Use that information at your discretion; we are not liable for it.

    11. Intellectual property

    11.1 Guidya’s intellectual property

    Elements of the Service — including trademarks, logos, text, data, drawings, graphics, photos, animations, sounds, code, layout, and downloadable documents — are and remain our property or that of our licensors. The design, form, and content of the Service are our exclusive property, excluding User-generated content.

    Site content (images, text, videos, databases, etc.) is governed by Moroccan intellectual property law. If you believe content infringes rights, contact Guidya at hello@guidya.com with the subject “Intellectual property – Abuse”.

    We grant only a right to view Service content privately, not for public display. Reproduction is limited to digital copies on your viewing device for browsing. Any other use (reproducing trademarks or logos, extracting databases, etc.) requires our prior express authorization.

    11.2 Users’ intellectual property

    You remain the sole owner of rights in User Content you publish, under your sole responsibility.

    By creating and publishing User Content, you grant Guidya a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to access, store, use, reproduce, adapt, publish, and process data published on the Service to operate Guidya’s services.

    12. Communications

    As a Recruiter or Administrator, you agree that no advertising message, internal or external communication, or information to clients or employees may use Guidya branding (name, logo, trademarks, etc.) in a way that is:

    • Disparaging, defamatory, insulting, or abusive;
    • Misleading or likely to mislead;
    • Unauthorized for commercial or promotional purposes.

    Any use of Guidya assets to illustrate offers or communications requires our prior explicit approval.

    13. Contractual framework

    The contractual framework for use of the Service (“the Agreement”) consists of the following documents, in descending order of priority:

    1. These Terms of Use;
    2. Guidya’s Privacy Policy.

    If documents conflict, the higher-ranking document prevails for the obligation at issue.

    14. Evidence

    Under applicable law, you agree that digital data recorded on our servers or under our control and stored with reasonable security constitute proof of any use of a service or other exchange between us (emails, connections to the Service, etc.). Such records are admissible with the same force as written documents unless proven otherwise.

    15. Validity of contractual terms

    If any provision of this Agreement is held invalid under applicable law or a final court decision, it is deemed unwritten without invalidating the Agreement or affecting other provisions.

    16. No waiver

    Failure by either party to enforce a clause or acquiescence in non-performance, permanently or temporarily, is not a waiver of rights under that clause.

    17. Changes to the Terms of Use

    We may update the Agreement documents (TOU, Privacy Policy, etc.) as features evolve. Material changes will be notified prominently on the Service or by other means such as email so you can review them before they take effect. If you object, you may close your account.

    Changes apply one month after notice.

    If you continue using the Service after publication of TOU changes or notice, use is governed by the updated TOU from their effective date.

    18. Email communications

    Under applicable law, you accept that we may send you by email information necessary to subscribe to or provide the Service, and generally any information related to performance of these TOU and the Agreement.

    We will use the email address(es) you provided.

    19. Jurisdiction and governing law

    These TOU are governed by Moroccan law as to their validity, interpretation, and performance.

    19.1 Student and graduate Members

    For consumer disputes, please first write to us at 13 BD MED V, 3rd floor, Lot AL Yousser, Berrechid, or by email to hello@guidya.com with the subject “Legal”. If proposed solutions are unsatisfactory and the dispute concerns an online service subscription, you may use mediation or bring the matter before competent courts.

    19.2 Recruiters

    Disputes related to your role as Recruiter acting for the Company are governed by the contract between the Company and Guidya. Failing such terms, disputes shall be settled amicably; failing agreement, exclusive jurisdiction lies with the courts of the Court of Appeal of Berrechid, notwithstanding multiple defendants or third-party proceedings.

    19.3 Administrators

    Disputes related to your role as Institution Administrator acting for the Institution are governed by the contract between the Institution and Guidya.
